The US Department of Commerce (DOC) has announced that it has again amended the order and the final determination regarding its antidumping investigation on imports of reinforcing bars from Turkey, on the grounds that the final determination was not in harmony with the United States Court of International Trade (CIT).

Accordingly, the DOC has determined the following new dumping margins:

HABAS – 3.96 percent

ICDAS – 4.17 percent

All others – 4.07 percent

In May 2017, the DOC announced its final determination in the antidumping investigation covering the period between July 1, 2015 and June 30, 2016, determining dumping margins of 5.39 percent for HABAS 8.17 percent for ICDAS and 6.94 percent for all others. After HABAS and ICDAS appealed the decision, the CIT remanded the DOC’s decision and requested the DOC to recalculate the dumping margins. In July 2017, the DOC amended its antidumping order regarding its antidumping investigation on imports of reinforcing bars from Turkey.

The US Department of Commerce has recalculated the antidumping duty on reinforcing bar imports from Turkey, as per sources.

The US DOC had calculated the antidumping duty rate for reinforcing bar imports from Turkey as zero percent in its final decision made on September 9, 2014. However, the US industry appealed the DOC’s final determination to the US Court of International Trade (CIT). Accordingly, the DOC has amended the dumping margin for reinforcing bars from Turkey from zero percent to 3.64 percent.

According to market sources, the US DOC has amended the dumping margin for Turkish rebar producer ICDAS Celik Enerji Tersane ve Ulasim Sanayi A.S. from zero percent to 3.64 percent, though the dumping margin for Turkish producer Habas Sinai ve Tibbi Gazlar Istihsal Endustrisi A.S has remained at zero percent. At the same time, for all other Turkish producers and exporters, the dumping margin has increased to 3.64 percent.

The DOC will submit its final redetermination to the CIT by April 7, while the DOC’s original negative final determination remains in effect throughout the appeal process.
